Terms and Conditions for Mountain Adventure Treks
1. Booking and Payment Terms
By booking a trek with Mountain Adventure Treks, you agree to the following payment terms:
- A non-refundable deposit of 30% of the total trek cost is required to confirm your booking
- Full payment must be received 30 days prior to the trek start date
- For bookings made within 30 days of the trek, full payment is required immediately
- All payments must be made through our authorized payment channels
- Prices are subject to change without prior notice until booking is confirmed
2. Cancellation Policy
Our cancellation policy is structured as follows:
- Cancellation 30+ days before trek: Full refund minus deposit
- Cancellation 15-29 days before trek: 50% refund minus deposit
- Cancellation 7-14 days before trek: 25% refund minus deposit
- Cancellation less than 7 days before trek: No refund
- No-show: No refund
3. Health and Fitness Requirements
Participants must:
- Be in good physical and mental health
- Disclose any medical conditions or allergies during booking
- Obtain medical clearance if requested by our team
- Maintain the fitness level required for the specific trek
- Accept that the trek leader's decision regarding their fitness to continue is final
4. Risk Acknowledgment
Trekking involves inherent risks. By participating, you acknowledge:
- Mountain trekking is an adventure sport with inherent risks
- Weather conditions can change rapidly in mountain environments
- Altitude sickness is a possibility on high-altitude treks
- Emergency medical facilities may be hours or days away
- You participate in all activities at your own risk
5. Insurance Requirements
All participants must have:
- Valid travel insurance covering adventure activities
- Medical insurance with emergency evacuation coverage
- Insurance documentation must be provided prior to trek commencement
- The policy must be valid for the entire duration of the trek
6. Trek Modifications
We reserve the right to:
- Modify trek routes due to weather or safety concerns
- Cancel or postpone treks due to unforeseen circumstances
- Alter itineraries based on local conditions
- Remove participants who violate safety guidelines
- Make changes necessary for group safety and well-being
7. Participant Responsibilities
All trekkers must:
- Follow guide instructions at all times
- Use provided safety equipment properly
- Stay with the group unless otherwise authorized
- Respect local customs and environment
- Adhere to Leave No Trace principles
8. Equipment and Gear
Regarding trekking equipment:
- Participants must bring all items on the provided gear list
- Equipment must meet our safety standards
- We reserve the right to reject unsuitable equipment
- Rental equipment must be returned in good condition
- Damages to rental equipment will be charged accordingly
9. Media and Privacy
By participating in our treks:
- You grant us permission to use photos/videos for promotional purposes
- You may opt-out of media usage in writing before the trek
- We maintain confidentiality of your personal information
- We may share necessary information with emergency services if required
10. Force Majeure
We are not liable for events beyond our control, including:
- Natural disasters
- Political unrest
- Pandemics or health emergencies
- Government policy changes
- Weather conditions affecting safety
11. Liability Limitations
Our liability is limited to:
- The cost of the trek package purchased
- Proven negligence by our staff
- Areas not excluded by these terms
- Incidents within our direct control
12. Complaint Resolution
For any complaints:
- Issues must be reported immediately to trek leaders
- Written complaints must be submitted within 28 days
- We aim to resolve all complaints within 45 days
- Unresolved disputes may be referred to arbitration
13. Age and Documentation Requirements
Participants must:
- Be 18 years or older (minors must be accompanied by guardians)
- Provide valid identification documents
- Submit all required permits and paperwork
- Have valid visas where applicable
14. Code of Conduct
All participants must:
- Respect fellow trekkers and staff
- Follow environmental guidelines
- Abstain from illegal activities
- Maintain appropriate behavior
- Comply with local regulations
15. Agreement Acknowledgment
By booking with us, you acknowledge that:
- You have read and understood these terms
- You accept all conditions specified
- You agree to comply with trek leader decisions
- You understand the risks involved
- You accept the booking conditions
